These terms apply to the TrackJam app and website, run by Onlinemaat, De Vroedschap 32, 2922 VC Krimpen aan den IJssel, the Netherlands, KvK number 84372761 ("TrackJam", "we"). By playing you agree to them.

1. Who can play

You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these terms for you. One account per person. Keep your sign-in secure; you are responsible for what happens on your account.

2. The game

TrackJam lets you describe a song, have it generated by AI, add a cover and a title, and compete in battles where other players vote. Some players in battles are house artists: computer players run by us, always labelled as such. House artists never take chart places or rewards from real players. Battle times, prices, rewards and features can change as we improve the game.

3. Credits, tokens and plans

• AI credits pay for songs and AI covers. Jam Tokens buy cosmetics only. Both are licences to use features in TrackJam, have no cash value, cannot be transferred or exchanged for money, and are not refundable except where the law or the app store's rules require it.
• Credits you buy never expire. Credits granted by a plan are added each billing period, and unused ones carry over: credits don't expire while your account exists, also after a plan ends.
• Subscriptions (Starter, Pro, Legend) renew automatically each month until you cancel them in your App Store or Google Play account. Cancelling stops the next renewal; you keep the benefits until the end of the paid period.
• Purchases are handled by Apple or Google under their terms. Refund requests go to them.
• For players in the EU: digital content is delivered right away. By buying, you ask us to start immediately and you accept that you lose your right of withdrawal once the content has been delivered.

4. Your content

"Your content" means your prompts, lyrics, titles, recordings, photos, comments, chat messages and the songs and covers generated for you.

• You keep whatever rights you have in your content. You give TrackJam a worldwide, non-exclusive, royalty-free licence to host, store, process, play, display and distribute it in order to run, improve and promote TrackJam (for example on share pages, charts and our social media). The licence ends when you delete the content or your account, except for copies other players already shared and our backups for their retention period.
• Only upload photos and recordings you made yourself or have permission to use.
• AI-generated songs and covers: they are created by third-party AI services. Subject to those services' terms, you may use songs and covers you made on TrackJam for personal, non-commercial purposes, including sharing them on social media. [Confirm against the ElevenLabs/Lyria and fal.ai licences, and state whether commercial use is allowed.] AI output can resemble existing works by accident; do not use it in ways that infringe someone else's rights.

5. Rules

Do not create, upload or post anything that:

• is hateful, harassing, threatening or bullying, or targets a real person;
• is sexual, sexualises minors in any way, or is excessively violent;
• names real artists, songwriters, songs, albums or labels, imitates their voices, or copies existing lyrics;
• infringes anyone's copyright, trademarks or other rights;
• is illegal, promotes self-harm, drugs or violence, or contains personal information of others;
• is spam, advertising, or an attempt to cheat: multiple accounts, vote trading, bots, exploiting bugs.

You also may not use songs or covers from TrackJam to train or improve AI models, or break the usage policies of our AI providers (ElevenLabs, fal.ai), which we pass on to you. If you break these rules and a third party makes a claim against us or our providers because of it, you are responsible for the damage, to the extent the law allows.

We check prompts, titles, covers, comments and chat automatically, and players can report and block anyone. We may remove content, reset rewards gained by cheating, and suspend or ban accounts that break these rules. If you think we got it wrong, email trackjamgame@gmail.com and a person will look at it.

6. Ending your account

You can delete your account at any time in the app (Me > Delete account) or at trackjam.net/delete-account. Deleting does not cancel an App Store or Google Play subscription; cancel it there first. Unused credits and tokens are lost when the account is deleted.

7. Liability

TrackJam is provided as it is. We do our best to keep it running, but battles can be interrupted and AI output can be unexpected. To the extent Dutch law allows, we are not liable for indirect damage or loss of data or virtual items, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.

8. Changes and law

We may change these terms. We will tell you in the app about important changes before they take effect. Dutch law applies. Disputes go to the competent court in the Netherlands, unless consumer law gives you the right to go to a court where you live.

9. App stores

If you downloaded TrackJam from the App Store, these terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance, is not responsible for claims about the app, and is a third-party beneficiary of these terms. The same applies to Google for Google Play.
